California rental law at a glance
As of July 1, 2024, security deposits are capped at one month's rent. Small landlords (who own no more than two residential properties with up to four units total) may collect up to two months' rent.
Landlord must return the deposit within 21 days after the tenant moves out, with an itemized statement of any deductions.
A tenant must give at least 30 days' notice to end a month-to-month tenancy. A landlord must give 30 days (if the tenant has lived there under a year) or 60 days (one year or more).
Late fees must be a reasonable estimate of the landlord's actual costs from the late payment. Fixed penalties that aren't tied to actual costs are generally unenforceable.
