This Sublease Agreement between Maria Delgado ("Sublessor") and James Okafor ("Sublessee"). The Sublessor agrees to rent to the Sublessee, and the Sublessee agrees to rent from the Sublessor, the premises described below on the terms set out in this Agreement.
This Sublease is subject to a master lease between the Sublessor and Larkspur Property Management (the "Master Landlord"). The Sublessee agrees to be bound by all terms of the master lease and to do nothing that would place the Sublessor in violation of it. The Master Landlord has consented to this Sublease.
The Sublessor rents to the Sublessee the premises located at 147 Cedar Street, Apt 3B, San Jose, CA 95110 (apartment). The premises are rented unfurnished.
This is a fixed-term lease beginning [start date] and ending [end date]. At the end of the term the tenancy does not automatically renew unless the parties agree in writing or as otherwise required by law.
The Sublessee shall pay rent of $2,400.00 per month, due on the 1st of each month. Pay by bank transfer or check to the Landlord. If rent is not paid within 5 day(s) of the due date, a late fee of $75.00 applies, to the extent permitted by California law.
The Sublessee shall pay a security deposit of $2,400.00 before taking possession. The Sublessor shall return the deposit, less any lawful deductions, within 21 days after the Sublessee vacates, as required by California law. An itemized statement of any deductions will be provided.
The premises shall be used only as a private residence by the Sublessee and no more than 2 occupant(s) total. The Sublessee shall not use the premises for any unlawful purpose and shall comply with all applicable laws and any reasonable rules provided by the Sublessor.
Tenant pays electricity, gas, and internet. Landlord pays water, sewer, and trash.
No pets are permitted on the premises without the Sublessor's prior written consent, except assistance animals as required by law.
Smoking is not permitted anywhere on the premises.
The Sublessee shall keep the premises clean and in good condition and shall promptly notify the Sublessor of any needed repairs. The Sublessor shall maintain the premises in a habitable condition as required by law. The Sublessee is responsible for damage caused by the Sublessee, occupants, or guests beyond normal wear and tear.
The Sublessor may enter the premises to inspect, make repairs, or show the unit after giving the Sublessee reasonable advance notice (generally at least 24 hours), except in an emergency, as permitted by California law.
This Agreement is governed by the laws of California. It constitutes the entire agreement between the parties and may be changed only in writing signed by both parties. If any provision is found unenforceable, the remaining provisions stay in effect.
By signing below, the parties agree to the terms of this Sublease Agreement.
