1. Parties

This Room Rental Agreement between Maria Delgado ("Landlord") and James Okafor ("Tenant"). The Landlord agrees to rent to the Tenant, and the Tenant agrees to rent from the Landlord, the premises described below on the terms set out in this Agreement.

2. Premises

The Landlord rents to the Tenant the premises located at 147 Cedar Street, Apt 3B, San Jose, CA 95110 (room). The premises are rented unfurnished. The Tenant rents the following room: Furnished bedroom on the second floor with private closet.. The Tenant may share the following common areas: Kitchen, living room, and one shared bathroom..

3. Term

This is a fixed-term lease beginning [start date] and ending [end date]. At the end of the term the tenancy does not automatically renew unless the parties agree in writing or as otherwise required by law.

4. Rent

The Tenant shall pay rent of $950.00 per month, due on the 1st of each month. Pay by bank transfer or check to the Landlord. If rent is not paid within 5 day(s) of the due date, a late fee of $75.00 applies, to the extent permitted by California law.

5. Security Deposit

The Tenant shall pay a security deposit of $950.00 before taking possession. The Landlord shall return the deposit, less any lawful deductions, within 21 days after the Tenant vacates, as required by California law. An itemized statement of any deductions will be provided.

6. Occupancy & Use

The premises shall be used only as a private residence by the Tenant and no more than 2 occupant(s) total. The Tenant shall not use the premises for any unlawful purpose and shall comply with all applicable laws and any reasonable rules provided by the Landlord.

7. Utilities

Tenant pays electricity, gas, and internet. Landlord pays water, sewer, and trash.

8. Pets

No pets are permitted on the premises without the Landlord's prior written consent, except assistance animals as required by law.

9. Smoking

Smoking is not permitted anywhere on the premises.

10. Assignment & Subletting

The Tenant shall not sublet the premises or assign this Agreement without the Landlord's prior written consent.

11. Maintenance & Repairs

The Tenant shall keep the premises clean and in good condition and shall promptly notify the Landlord of any needed repairs. The Landlord shall maintain the premises in a habitable condition as required by law. The Tenant is responsible for damage caused by the Tenant, occupants, or guests beyond normal wear and tear.

12. Right of Entry

The Landlord may enter the premises to inspect, make repairs, or show the unit after giving the Tenant reasonable advance notice (generally at least 24 hours), except in an emergency, as permitted by California law.

13. Governing Law & Entire Agreement

This Agreement is governed by the laws of California. It constitutes the entire agreement between the parties and may be changed only in writing signed by both parties. If any provision is found unenforceable, the remaining provisions stay in effect.
